In the Shadows: Non-citizens and U.S. Violations of the International Covenant on Civil and Political Rights

The CLE seminar will highlight the situation of refugees and immigrants in the U.S., in particular regarding the violation of their human rights guaranteed by the International Covenant on Civil and Political Rights (ICCPR), which the U.S. has signed. The CLE will address the scope of the ICCPR, mechanisms for enforcement and U.S. compliance, as well as a discussion on how to advocate for clients using this system.

1:00-2:15 Shadowing human rights: the International Covenant on Civil and Political Rights and U.n. mechanisms to Enforce Human Rights PRotections
What is the ICCPR? What rights pertaining to refugees and immigrants are guaranteed by the ICCPR? Is the U.S. bound to comply with the ICCPR? How is the ICCPR used to monitor human rights situations and to make claims of human rights violations? These questions and more will be addressed by a panel of experts.

2:30-4:00 COMING OUT OF THE SHADOWS: U.S. VIOLATIONS OF THE RIGHTS OF
ALIENS UNDER THE ICCPR
The Advocates for Human Rights, along with a team of volunteers from the law firm of Halleland Lewis Nilan & Johnson and 60 U.S.-based non-governmental organizations, wrote a Shadow Report to bring their concerns about the treatment of non-citizens in the U.S. to the attention of the U.N. Human Rights Committee. The ICCPR includes provisions related to due process, right to counsel for individuals in removal proceedings (including refugees, asylum seekers, juveniles and lawful permanent residents), detention matters, as well as the rights of migrant workers to freedom of association and nondiscrimination. This session will provide an overview of the report and panelists will discuss the sections of the Shadow Report addressing the above issue.
4:00-4:30 Staying out of the shadows: Strategies for Advocating for our clients using U.N. mechanisms
Participants will have the opportunity to dialogue with the panelists about how advocates can be involved in the ICCPR reporting process and how they can use this system to protect and enforce the rights of their clients in the U.S. under the ICCPR.
